What is “Subject-To” and how does it work?

“Subject-to” means we purchase a property subject to the existing mortgage — the loan stays in place, and we take over the payments. Your client avoids foreclosure or distress, and the mortgage gets handled responsibly. This is completely legal and often used to help sellers with little to no equity.

Is this legal?

Yes — the IRS even references this strategy (Publication 537), and it’s listed on official HUD-1 settlement statements. We work with licensed title companies, use proper documentation (Deed of Trust, Promissory Note), and ensure everything is above board.

How is my client protected?

We use a legal Deed of Trust and Promissory Note, enforced by a neutral title company. If we don’t perform, ownership reverts back to the seller — and they keep all funds paid up to that point. We also use loan servicing companies for third-party accountability.

Do you make payments to the seller?

Nope. We keep it simple and safe. All payments go through a licensed loan servicing company, which handles statements, collections, and ensures mortgage payments are always made on time.

What happens if you stop paying?

In the unlikely event something went wrong, the Deed of Trust protects your client. Ownership would revert to them, and they would keep all funds received. That’s why we structure every deal with protection and peace of mind built in.
